                                                                             Purchase Conditions

• 1. Breeder represents and warrants, to the best of my knowledge, that the above dog/puppy is in good health and is a purebred Dachshund with AKC registered parents. The buyer will assume full responsibility for the health, temperament, behavior and appearance of the above dog/puppy upon possession. The decision to breed is at the discretion of the new owner with full A.K.C. registration papers and we can not be held responsible for any offspring it may produce. Puppy is to be spayed or Neutered by 6 months of age (unless puppy is sold for show or breeding purposes and marked with a full registration above).
  

• 2. Replacement will be made if the following conditions are met: Buyer should have the puppy checked by his/her veterinarian within 72 hours from purchase date, said date being the date the last party signs this document or the contract is voided. If the puppy is found unhealthy buyer may return the puppy for a replacement of same or equal value and sex, if the puppy is found  to have a life-altering or fatal genetic defect by age 6 months that is diagnosed by a licensed vet buyer has 2 days to notify breeder of the vet's findings in writing and the puppy will be returned to breeder within 10 days after the exam at buyers expense. If the puppy dies a necropsy must be done to determine the cause of death at buyers expense.  Breeder is not responsible for any medical expenses.
  

• 3.  A replacement will be made, upon availability, with a puppy of the same sex and  value, after the puppy is returned at buyer's expense along with a written report from the treating veterinarian and all paperwork provided by seller at the time of sale. Breeder will not replace the puppy if the breeder was not advised of it's being ill beforehand or put to sleep with out permission. No cash refunds will be given. NO EXCEPTIONS.
  

• 4. We do not guarantee adult size, conformation nor color or coat (including alopecia which is found in some dilute colors) of    any puppy,  Further we do not guarantee the health of the dog/puppy against common canine viruses once it leaves our care.
  

• 5. We highly recommend and feed our puppies Puppy Chow, if you plan to feed any other food do so gradually to avoid an upset stomach in your puppy.
  

• 6. A non-refundable deposit of $200 is required to secure a sale. This deposit must be tendered contemporaneously with signing of this agreement by the buyer. Refunds will only be given should the dog/puppy develop problems while still in our care. The Balance of the puppy price is due when puppy is 6 - 8 weeks old or when the puppy leaves our care, whichever occurs first.
  

• 7. Shipping amount is $______ . PUPPY MUST BE A MINIMUM AGE OF 8 WEEKS OLD TO SHIP. Shipping is subject to change due to the status of the prevailing airline rates. Weather conditions effect shipping and if an additional health certificate is required buyer is responsible for any fee involved in procuring said certificate which is in addition to the base shipping fee.
  

• 8. Seller will not be obligated to give a refund for deposits on shipping. NO EXCEPTIONS. First shot and de worming, crate and one health certificate are included with the price of shipping. If shipping rates have increased, seller shall notify the buyer prior to shipping.
  

• 9. This agreement shall be governed by, enforced and construed under the laws of the State of Alabama (without regard to its conflicts of laws provisions). Venue of any proceeding regarding this agreement shall be in Mobile County, Alabama.
  

• 10. This agreement may be executed in one or more counterparts, all of which shall be considered one and the same agreement and shall become effective as of the date set forth below when one or more counterparts have been signed and dated by the last party to so sign.
  

• 11. All covenants, agreements, warranties, provisions, rights and obligations of this sales contract shall be binding upon and inure to the benefit of the parties here to and their respective heirs, executors, administrator, personal representatives, successors and permitted assigns.
  

• 12. This sales contract contains the sole and entire agreement between the parties with respect to the transaction contemplated hereunder and no representation, inducement, promise, or agreement, parole or written, between the parties not incorporated or referenced herein shall be of any force and effect. Any amendment to this sales contract shall be in writing and executed and dated by both parties.
  

• 13. In the event it becomes necessary for Seller to institute legal proceedings or employ an attorney to enforce any obligations of the Buyer hereunder, Buyer shall pay all costs of collection, including reasonable attorney's fees.
  

I, the Seller and I, the Buyer, have read this sales contract thoroughly, understand all of its

provisions and are in full agreement with the above stipulations.

IT IS FURTHER UNDERSTOOD THIS IS A LEGALLY BINDING AGREEMENT, THAT

THE BUYER IS ADVISED TO SEEK LEGAL COUNSEL TO REVIEW THIS DOCUMENT PRIOR TO SIGNING AND THAT BY SIGNING THE BUYER ASSUMES ALL RIGHTS AND RESPONSIBILITIES HEREUNDER.
